Overview

These Terms of Use ("Terms") govern your access to and use of the Nearby Folk Android application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.

Your use of Nearby Folk is also subject to our Community Guidelines, Safety Policy, and Privacy Policy.

1. Eligibility

• You must be at least 16 years old to use Nearby Folk.
• You must have the legal capacity to enter into a binding agreement.
• You must not be barred from using the Service under applicable law.

2. Your Account

• You are responsible for keeping your email address, password, login credentials, and account secure.
• You agree to provide accurate information and keep your profile up to date.
• You are responsible for all activity that happens through your account.

3. Acceptable Use

You agree not to use Nearby Folk to:

• Harass, threaten, stalk, intimidate, or bully any user.
• Post or share hate speech, discrimination, or content targeting people based on identity.
• Share sexually explicit content, nudity, content involving minors, or any form of child exploitation.
• Solicit, sell, or advertise illegal goods, services, or activities.
• Impersonate any person, brand, or entity, or misrepresent your identity.
• Spam, scam, phish, or otherwise mislead users.
• Attempt to scrape, reverse engineer, or compromise the Service.
• Use the Service for any unlawful purpose or in violation of Indian or other applicable law.

4. User-Generated Content

• You retain ownership of the content you create or upload.
• By posting content on Nearby Folk, you grant us a worldwide, royalty-free, non-exclusive license to host, store, reproduce, and display that content for the purpose of operating and improving the Service.
• You are solely responsible for the content you post and any consequences of doing so.
• We may, but are not obligated to, review, moderate, restrict, or remove any content at our discretion.

5. Reporting and Moderation

Every user, chat, voice room, post, and Space can be reported. Our moderation team reviews reports and may issue warnings, restrict features, suspend accounts, or ban users at our sole discretion. Repeated or severe violations may result in permanent bans.

6. Voice Rooms and Live Audio

• You agree to behave respectfully in voice rooms.
• Voice room hosts are responsible for moderating their rooms.
• Recording or distributing voice room audio without consent is prohibited.

7. Premium and Ghost Mode

Premium features, such as extended radar, advanced filters, profile boost, and Ghost Mode, may be offered as paid subscriptions. Pricing and availability may change. Subscriptions auto-renew unless cancelled under the applicable billing rules.

• Monthly Premium is currently priced at Rs. 99 per month.
• Yearly Premium is currently priced at Rs. 999 per year.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel subscriptions through the payment provider or platform through which you purchased the subscription.

8. Location and Privacy

Use of the Nearby radar requires location access. We display only approximate distance buckets to other users, never your exact GPS coordinates. See our Privacy Policy for full details.

9. App Distribution

Nearby Folk is currently distributed through official app stores, including the Apple App Store and Google Play Store.

You should only download or install Nearby Folk from official sources. We are not responsible for modified, repackaged, unofficial, or third-party versions of the App.

If you download Nearby Folk from the Apple App Store or Google Play Store, the store’s own terms and billing rules may also apply.

10. Termination

You may delete your account at any time from in-app Settings. For details about the process, retention window, and support options, see our Account Deletion page or email support@nearbyfolk.com. We may suspend or terminate accounts that violate these Terms or our Community Guidelines, with or without notice.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or always available.

We do not guarantee that you will meet, connect with, or form relationships with any particular user through the Service.

12. Limitation of Liability

To the maximum extent permitted by law, Nearby Folk and its affiliates, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.

13. Indemnity

You agree to indemnify and hold harmless Nearby Folk and its team from any claims, damages, liabilities, or costs (including legal fees) arising out of your use of the Service, your content, or your violation of these Terms.

14. Governing Law

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts of India.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated in-app or on this website. Continued use of the Service after such changes constitutes your acceptance of the updated Terms.
